MTP Ordinance No. 671/2021 represented an important milestone in modernizing labor rules, especially regarding time and attendance tracking. Among the various topics addressed, the regulation organized and classified the types of electronic time clock systems that companies can adopt, bringing greater legal clarity and operational flexibility.

Currently, the legislation recognizes three types of electronic time recorders, each suitable for different business realities.

1. Conventional Electronic Time Recorder (REP-C)

The REP-C is the most traditional type of electronic time tracking. It consists of the physical equipment installed on the premises, used by the employee to record entries, exits, and breaks.

This type of recorder has strict technical requirements, such as certification, data inviolability, and the generation of reliable records, ensuring information integrity. Due to these characteristics, the REP-C remains widely used in in-person environments, especially in companies with a large number of employees or well-defined operational routines.

2. Program-Based Electronic Time Recorder (REP-P)

The REP-P is a software-based solution that can operate on local servers or in a cloud environment. Unlike the conventional model, it does not exclusively depend on a specific physical device to function; the ideal solution for this REP is Hardware + Software.

This modality allows for the use of more modern technologies, such as applications, web platforms, facial biometric recognition, and integration with other management systems. The focus of the REP-P is on traceability, information security, and the impossibility of undue alteration of records.

The REP-P is especially suitable for companies with external collaborators, hybrid teams, or those seeking greater automation and flexibility in time and attendance tracking.

3. Alternative Electronic Time Recorder (REP-A)

The REP-A corresponds to alternative time clock solutions, the use of which depends on provisions in collective bargaining agreements or conventions. Although Ordinance 671 reorganized the rules, this model already existed previously (the old time clock from Ordinance 373/2011) and was maintained in the legislation.

The alternative system can take different technological formats, provided it ensures employee identification, correct time tracking, and the possibility of auditing information. It is an option typically adopted in specific contexts where there is collective negotiation authorizing specific rules for time and attendance tracking.

Ordinance 671/2021 expanded the possibilities for time and attendance tracking, allowing companies to choose the most suitable model for their operational reality, without compromising legal compliance.

Whether through REP-C, REP-P, or REP-A, the central point remains the same: ensuring reliable, transparent, and secure records, protecting both the employer and the employee.
